Artist Agreement is as follows. Artists whose music is played on the station will agree to and understand the following. Artists please scroll down to artist agreement.

LISTENER AGREEMENT

1. Listeners understand that The Que 98.2 FM internet radio is for listening pleasure only.

2. Listeners agree to not attempt illegal download of artists music at anytime and understand that this is a violation of applicable copyright laws.

 3. Listener understands that if they knowingly download the music  without artist permission, their IP address will be ban from this website and they will be subject to lawful prosecution in a court of law.

4. Listeners agree that if they want to download the music of artists, they will do so by going to the respective artists website and paying the applicable fee for downloads, or first obtaining artist permission in writing, then showing us that you have obtained permission to do so. We take copyright violations very seriously!!

 
Please Note: Because The Que 98.2 FM internet radio falls under the royalty waiver act .

ARTIST AGREEMENT

1. Artists understand that there is no financial compensation for airplay or rotation of their music on this radio station. Because The Que 98.2 FM does not make revenue directly off of the airplay or rotation of artists' music, and the only source of revenue is through air slots sold to advertising businesses, artists will therefore receive no financial compensation for the airplay of their music.



2. Re - Use fee waiver for BMI, ASCAP and other performing rights artists.


Artists who belong to the above named organizations agree to waive their rights to be paid re - use fees. Again artists understand that there is no revenue generated from the direct rotation of their music and therefore they and the performing rights organization understand that any attempts to collect re - use fees will be in violation of this legal waiver and contract. Artists agree in the legal interest of all parties, that any attempt to force the re - use fees issue, will result in their music being removed from The Que 98.2 FM internet radio station immediatly.



3. Artists understand that airplay or rotation of their music is being provided as an in kind service. It is therefore understood that this radio broadcasting service is being provided on an AS IS basis. Airomee Wind, Cimplex Music Studios, Inc and The Que 98.2 FM therefore make no express or implied warranties concerning the reliability of the internet broadcast, nor the stations up or down times.




4. All members agree to respect each others privacy including restricted access to the Cimplex Music Studios databases. Airomee Wind, Cimplex Music Studios and The Que 98.2 FM will not knowingly share the contact info of any member or party of this radio promotion program, or any other details that would violate the direct privacy of such members. The Que 98.2 FM will not use artists music for any other reason than radio airplay or rotation, unless otherwise specified by artists and promoter (promoter = Airomee Wind, Cimplex Music Studios, Inc, The Que 98.2 FM internet radio) for future opportunities for which there would be financial compensation.



5. Artists agree that all music submitted has been registered with The U.S. Copyright Office and is protected by copyright law. Artists and promoter agree to do what is in their ability, to protect artists music from knowingly being pirated or used in ways that would violate copyright laws.

6. Artists understand that music which contains words or sounds suggesting sex, violence, suggestive or any other inappropriate material will not be airplayed on this station.



Organization = Airomee Wind, Cimplex Music Studios and The Que 98.2 FM internet radio.


7. Artists agree to not put unreasonable demands on Airomee Wind, Cimplex Music Studio, The Que 98.2 FM internet radio.


Artists will not undermine, demean or attempt to damage the reputation of Airomee Wind or the said organization. All members understand that any person, especially artists who put unreasonable demands on Airomee Wind or the organization will have their music suspended from airplay permanantly.


8.Artists agree that should opportunities arise to further promote artists in which financial compensation will be distributed. That the organization will retain 30% to cover it's cost and give the artist/s 70% for fair compensation.

9.All members understand that the organization has the interest of the artists at center of it's operations. All members are aware that the organization will do everything in it's ability to protect the rights and interests of all members.



This agreement is legally enforcable.

Anyone attempting to misuse or abuse this website in any way, will be prosecuted to the maximum extent allowed by law.
